Proposed Rules on Aesthetic Mitigation and Decommissioning
Act 174 requires the Board to file proposed rules on maintenance of aesthetic mitigation measures and decommissioning.
As prescribed in Act 174, the Department of Public Service filed a petition and draft rules with the Board on November 1, 2016. The Board solicited comments on the Department of Public Service draft rules on November 9, 2016. Based on the comments received, the Board filed proposed rules with the Secretary of State on December 15, 2016.
The three proposed rules filed by the Board:
Proposed Amendments to Board Rule 5.400 (conforming amendments necessary to implement the proposed rule on decommissioning.
The Board sought comments on the proposed rules. Copies of the comments received on the rules are included below. At this time, the Board is in the process of considering the comments and developing a final proposed rule for submission to the Secretary of State and the Legislative Committee on Administrative Rules.
