Proposed Rules on Aesthetic Mitigation and Decommissioning

Act 174 requires the Board to file proposed rules on maintenance of aesthetic mitigation measures and decommissioning. 

As prescribed in Act 174, the Department of Public Service filed a petition and draft rules with the Board on November 1, 2016. The Board solicited comments on the Department of Public Service draft rules on November 9, 2016. Based on the comments received, the Board filed proposed rules with the Secretary of State on December 15, 2016.   

The three proposed rules filed by the Board:

Proposed rule on the installation and maintenance of aesthetic mitigation measures

Proposed rule on the decommissioning of electric generation, electric transmission, and natural gas facilities

Proposed Amendments to Board Rule 5.400 (conforming amendments necessary to implement the proposed rule on decommissioning.

Next Steps

As described in the memorandum announcing the filing of the proposed rules, the Board is inviting comment on the proposed rules consistent with the schedule outlined below:

February 24, 2017: Initial round of written comments on the proposed rules.  Comments should be filed via email with the Clerk of the Board at

February 28, 2017, at 7:00 P.M.: Public Hearing on the proposed rules at the Montpelier High School Auditorium, 15 High School Drive, Montpelier, VT.

March 9, 2017 at 9:30 A.M.: Workshop with Board staff.  The Workshop will be held at the Susan M. Hudson Hearing Room, 4th Floor, 112 State Street, Montpelier, VT. 

March 31, 2017: Final Comment deadline.
