Proposed Rule on Sound from Wind Generation Facilities

On June 13, 2016, Public Act 174 (Act 174) was signed into law. Section 12(a) of Act 174 requires the Public Service Board (Board) to adopt rules regarding sound from wind generation facilities. Section 12(a) reads as follows:

On or before July 1, 2017, the Public Service Board (the Board) shall finally adopt rules under 3 V.S.A. chapter 25 regarding sound from wind generation facilities approved under 30 V.S.A. § 248, unless such deadline is extended by the Legislative Committee on Administrative Rules pursuant to 3 V.S.A. § 843(c). In developing these rules, the Board shall consider:

  1. standards that apply to all wind generation facilities;
  2. a methodology for determining sound levels and measurement locations for each such facility on a case-by-case basis; or
  3. standards that apply to one or more categories of wind generation facilities, with a methodology for determining sound levels and measurement locations for other such facilities on a case-by-case basis.

Timeline

August 26, 2016: Request for Proposals
The Board requested comments and specific proposals for implementing Section 12(a) of Act 174.

September 20, 2016: Interested Persons
Deadline for any interested person wishing to receive information related to this rulemaking from the Board.

October 24, 2016: Submit Proposals
Deadline for proposals to be submitted to the Board. Proposals filed with the Board are accessible below.

November 16, 2016: Reply Comments
Deadline to submit reply comments. Reply comments filed with the Board are accessible below.

December 2, 2016: Workshop
The Board convened a workshop to allow participants to present and discuss their proposed rules.

January 9, 2017: Workshop
The Board will convene a second workshop to continue the presentations and discussion of proposed rules from the first workshop.

On January 20, 2017, the Board released a discussion draft of a proposed rule.  Comments on the discussion draft are requested by a deadline of February 3, 2017, consistent with the Board's letter requesting comments.

March 17, 2017: Rule Filed with Secretary of State
